Agreement to Terms

By accessing or using Honey Badger Boxes ("Service," "we," "us," "our") website and subscription services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Eligibility

• You must be at least 18 years old to purchase a membership
• You must provide accurate, current, and complete information
• You must maintain the security of your account credentials
• You are responsible for all activity under your account

Membership Subscription

Subscription Plans

• Monthly: Billed monthly, cancel anytime
• 6-Month: Billed upfront for 6 months, discounted rate
• Annual: Billed upfront for 12 months, discounted rate

Automatic Renewal

• Subscriptions automatically renew unless cancelled
• You authorize us to charge your payment method at each renewal
• We will notify you before charging for renewals
• You can cancel before renewal to avoid charges

Price Changes

• We reserve the right to change subscription prices
• Price changes will not affect your current subscription period
• We will notify you 30 days before new pricing takes effect
• Founding members receive locked-in pricing (grandfathered rates)

Cancellation

• Cancel anytime through your member portal or by emailing us
• Cancellation takes effect at the end of your billing period
• No refunds for partial months or unused time
• You retain access until the end of your paid period

What You're Subscribing To

Prototype Nature

• Honey Badger Boxes ships prototype kites in various stages of development
• Prototypes are test designs and may have imperfections
• Performance may vary; designs are subject to refinement
• Some prototypes may never be released to retail
• Your membership includes participation in the testing and feedback process

Monthly Deliveries

• Boxes ship by the 15th of each month
• Delivery times vary by location (typically 5-7 business days)
• You are responsible for providing accurate shipping information
• We are not responsible for delays caused by carriers or incorrect addresses

Contents

Each box typically includes:

• One exclusive prototype kite
• 2-3 accessories
• Educational content
• Member surprises

Contents are curated by us and are not customizable.

Feedback and Content

Optional Feedback

• Providing feedback on prototypes is optional but encouraged
• Feedback helps us improve designs and make retail decisions
• By providing feedback, you grant us the right to use it for product development

User-Generated Content

By submitting photos, videos, reviews, or other content ("Content"), you:

• Grant us a worldwide, royalty-free, perpetual license to use, display, and distribute your Content
• Confirm you own the Content or have permission to share it
• Agree your Content does not violate any laws or third-party rights
• Understand we may edit Content for length or clarity

We reserve the right to remove Content that violates these Terms.

Intellectual Property

Our Property

• All content on our website, including text, graphics, logos, images, and software, is owned by Honey Badger Boxes or our licensors
• You may not copy, reproduce, distribute, or create derivative works without permission
• Kite designs, educational materials, and branding are protected by intellectual property laws

Your License

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use the Service for personal, non-commercial purposes
• View and download educational materials for personal use
• Share photos of your kites on social media (with credit appreciated)

Prohibited Uses

You may not:

• Use the Service for illegal purposes
• Violate any local, state, national, or international law
• Infringe on intellectual property rights
• Transmit harmful code (viruses, malware, etc.)
• Harass, abuse, or harm others
• Impersonate others or provide false information
• Resell, redistribute, or commercially exploit products or content
• Scrape, data mine, or use automated tools on our site
• Interfere with the Service's operation

Community Guidelines

Forum and Community Behavior

• Be respectful and kind to fellow members
• No hate speech, discrimination, or harassment
• No spam or commercial solicitations
• Respect cultural traditions we explore
• Share helpful feedback constructively

We reserve the right to remove members who violate community guidelines.

Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The site is free of viruses or harmful components
• Results or information are accurate or reliable

Kite Flying Risks

• Kite flying carries inherent risks
• Fly responsibly and follow safety guidelines
• Check local regulations and weather conditions
• We are not liable for injuries or damages resulting from kite flying
• You assume all risks associated with using our products

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONEY BADGER BOXES SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruptions or data loss
• Any damages exceeding the amount you paid in the 12 months prior to the claim

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Honey Badger Boxes, our affiliates, and our employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your Content
• Your violation of any rights of others

Disputes and Governing Law

• Fail to pay subscription fees

Upon termination:

• You lose access to the member portal and community
• No refund for unused subscription time (unless we terminate without cause)
• Certain provisions of these Terms survive termination (liability limitations, indemnification, etc.)

Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy and Return Policy, constitute the entire agreement between you and Honey Badger Boxes.

Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

Assignment

You may not assign these Terms. We may assign our rights and obligations to any party.

Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, pandemics, strikes, etc.).
